  • These Terms and Conditions (“Agreement”) govern the access to and use of the mobile application, website, and services operated under the brand name Jibon Electric, owned and managed by ONEHORN INNOVATION PRIVATE LIMITED (“Company”, “we”, “us”, or “our”).

  • Jibon Electric provides electric vehicle rental and related mobility services through a self-service, app-based platform, subject to the terms set forth herein. This Agreement applies to all users (“User”, “Rider”, “you”, or “your”) who access, register, or use any services, vehicles, or features offered by Jibon Electric.

  • By accessing, registering on, or using the Jibon Electric application, website, or any vehicle provided by the Company, you acknowledge that you have read, understood, and agreed to be legally bound by this Agreement, including all policies, guidelines, and updates incorporated by reference. If you do not agree with any part of this Agreement, you must immediately discontinue use of the services and refrain from renting or operating any vehicle.

  • This Agreement constitutes a valid and binding electronic contract between you and ONEHORN INNOVATION PRIVATE LIMITED, enforceable under the laws of India. Continued use of the services shall be deemed as acceptance of the then-current version of this Agreement, as may be amended or updated from time to time.

  • The Company reserves the right to modify, amend, or update this Agreement at its sole discretion. Any such changes shall be effective upon posting on the application or website, and your continued use of the services after such posting shall constitute your acceptance of the revised terms.

    • 1. Overview of Services

  • This Agreement governs the use of the Jibon Electric mobile application, website, and related services (collectively, the “App”). By accessing or using the App or services, the user agrees to be bound by the terms of this Agreement, as updated from time to time. If the user does not agree to the terms, they must immediately discontinue use of the services.

  • The services provided by Jibon Electric primarily include the rental of electric vehicles through a self-service model, subject to availability, location, and operational constraints. Each rental plan may include access to a vehicle, limited battery usage as applicable to the plan, and basic support services as expressly communicated at the time of booking.

  • Jibon Electric does not currently provide 24/7 roadside assistance or on-demand repair services. Any assistance, support, inspection, or repair provided by Jibon Electric shall be at its sole discretion, based on availability, location, and operational feasibility. The absence of roadside assistance shall not be construed as a service deficiency.

  • Jibon Electric may introduce additional services in the future, including but not limited to roadside assistance, enhanced customer support, maintenance services, or third-party support offerings. Such services, if introduced, shall be subject to separate terms, availability, and additional charges, as notified through the App or website.

  • Vehicles rented through Jibon Electric may be used only by individuals who are at least 18 years of age, possess a valid driving license, and comply with all applicable laws and traffic regulations. The user represents and warrants that they meet all eligibility requirements at the time of renting and using a vehicle. The user acknowledges that Jibon Electric is not a public transport service or common carrier. The services are provided on a limited, non-exclusive, and revocable basis, and Jibon Electric reserves the right to restrict, suspend, or discontinue any part of the services at any time without prior notice. Availability of vehicles and services may vary by location, time, demand, and operational conditions. Jibon Electric does not guarantee continuous availability of vehicles or services at any location or time.

    • 2. Fees, Charges, and Payments

  • The user agrees to rent vehicles from Jibon Electric through the application or website, subject to the terms of this Agreement and the applicable rental plans, pricing, and policies in force at the time of booking. Rental fees, subscription charges, security deposits, service fees, taxes (including GST), and other applicable charges shall be payable as displayed on the app or otherwise communicated by Jibon Electric. Rental fees and related charges may vary based on location, plan type, duration, availability, and operational factors. Jibon Electric reserves the right to revise pricing, fees, or charges at its sole discretion from time to time.

  • All payments shall be made in advance through approved digital payment methods, including wallets, UPI, debit cards, credit cards, or other permitted modes. The user authorizes Jibon Electric to deduct applicable charges automatically from the user’s wallet balance, security deposit, or linked payment method. A security deposit may be required for availing the services. During the rental period, the user shall maintain a minimum balance in the wallet or deposit account as specified by Jibon Electric. Failure to maintain such balance may result in suspension or termination of the rental, automatic locking of the vehicle, or additional charges.

  • If the user fails to return the vehicle on time or incurs additional charges due to damage, penalties, service costs, or misuse, Jibon Electric reserves the right to recover such amounts from the security deposit or charge the user’s payment method without further notice. In the event of non-payment or delayed payment, Jibon Electric may levy late fees, suspend services, restrict access, or initiate recovery proceedings. The user agrees to bear all reasonable costs of recovery, including administrative or legal expenses.

  • The user acknowledges that wallet balances or deposits are not interest-bearing and are subject to deductions as per this Agreement. Refunds, if any, shall be processed only after adjustment of all outstanding dues and in accordance with Jibon Electric’s refund policy, if applicable.

    • 3. User Representations and Responsibilities

  • The user understands and agrees that the services provided by Jibon Electric are time-bound and that access to the vehicle is limited to the duration of the rental or subscription plan selected and paid for by the user. Any vehicle not returned or properly locked at the end of the rental period may be deemed lost, stolen, or misappropriated, and the user shall remain fully responsible until the vehicle is recovered and returned to Jibon Electric. The user accepts absolute responsibility and liability for the vehicle during the rental period, including responsibility for loss, theft, damage, misuse, vandalism, or impounding by any authority, whether caused directly or indirectly by the user or any third party. If the vehicle is damaged, stolen, seized, or lost during the rental period, the user shall be liable to compensate Jibon Electric for the full cost of recovery, repair, replacement, or loss, including accessories, parts, battery, and any associated expenses.

  • The user agrees that Jibon Electric shall be entitled to determine the extent of damage and the corresponding cost of repair or replacement at its sole discretion. Such amounts may be deducted from the user’s wallet, security deposit, linked payment method, or charged separately. In case of non-recovery of the vehicle, the user agrees to pay the full replacement value as determined by Jibon Electric. The user acknowledges that the battery, motor, electronics, accessories, and all components of the vehicle are integral parts of the vehicle, and loss or damage to any part, including the battery, shall be treated as loss or damage to the vehicle itself.

  • If the vehicle is impounded, confiscated, or seized by police or any government authority due to the user’s act, omission, or violation of law, the user shall bear all associated costs, including fines, penalties, legal expenses, towing, storage, and release charges, and Jibon Electric shall not be liable for any loss arising therefrom. The user authorizes Jibon Electric to charge, debit, or recover any outstanding dues, damages, penalties, or costs from the user’s linked payment instruments, wallet, or security deposit, and agrees to raise any dispute within a reasonable time as communicated by Jibon Electric. Failure to do so shall be deemed acceptance of such charges. The user agrees that any misuse, repeated violations, non-payment, disputes raised in bad faith, or abusive behavior may result in suspension, termination, or blacklisting of the user’s account without prior notice.

  • The user further acknowledges that geographical or operational restrictions may apply to the use of the vehicle, and agrees to operate the vehicle only within permitted areas and in accordance with instructions issued by Jibon Electric from time to time.

    • 4. Subscriptions Plans and Rental Billing

  • The rental fee or subscription fee applicable to the services shall be the fee selected by the user at the time of subscribing through the Jibon Electric application. Subscription fees may be charged on a daily, weekly, monthly, or other periodic basis, as specified in the selected plan. Jibon Electric reserves the right to revise, modify, or update subscription fees, plans, or benefits at any time, without any obligation to provide price protection or refunds for such changes. Subscription charges shall be billed in advance and may be automatically deducted from the user’s selected payment method, wallet balance, or security deposit, as applicable. The subscription period shall commence from the date and time of successful payment and activation of the plan through the app. If a vehicle is available in the user’s selected area, the user may rent a vehicle under the applicable subscription or rental plan. Jibon Electric does not guarantee continuous availability of vehicles at all times or locations.

  • The user may be required to pay a security deposit, rental fee, or other applicable charges as part of the subscription. The security deposit, if any, may be refunded subject to deductions for outstanding dues, damages, penalties, service costs, or other charges arising under this Agreement. Jibon Electric may offer promotional plans, free trials, discounts, or special third-party offers from time to time. Such offers are subject to specific terms, limited validity, and availability, and Jibon Electric shall not be responsible for third-party products or services included in such offers. The user may cancel their subscription at any time through the app or as otherwise communicated by Jibon Electric. Upon cancellation or expiry of a subscription, the user shall not be entitled to any refund for any unused portion of the subscription period, unless otherwise required by applicable law or expressly stated by Jibon Electric.

  • Jibon Electric reserves the right to suspend or terminate a subscription at any time for violation of this Agreement, misuse of services, non-payment, or any other material breach. In such cases, any paid fees may be forfeited, and additional charges, repair costs, or penalties may be recovered as per this Agreement. Failure to make timely payment of subscription fees, rental charges, or any other applicable amounts may result in suspension of services, deductions from the security deposit, late fees, or termination of the user’s account. Continued use of the services after any modification to subscription plans, pricing, or terms shall constitute the user’s acceptance of such changes.

    • 5. Rental, Inspection, Use, KYC, and Return of Vehicle

  • At the time of taking possession of a vehicle from Jibon Electric, the user acknowledges that they have inspected the vehicle and found it to be in proper working condition and acceptable for use, subject to normal wear and tear. The user agrees that they shall be responsible for any loss, theft, damage, or misuse of the vehicle during the rental period, except for damage caused solely due to manufacturing defects or reasons attributable to Jibon Electric. Before initiating a ride, the user shall conduct a basic safety inspection, including but not limited to checking brakes, lights, tires, battery charge, steering, and overall condition of the vehicle. The user agrees not to operate the vehicle if any defect, malfunction, or safety concern is noticed. In such cases, the user must immediately stop using the vehicle and report the issue through the Jibon Electric app or customer support. Failure to report defects may result in the user being held responsible for resulting damage.

  • The rental period shall commence from the time the vehicle is handed over to the user and shall continue until the vehicle is physically returned by the user to a designated or approved return location as communicated by Jibon Electric. The user is solely responsible for ensuring that the vehicle is properly returned, parked safely, and handed over at the designated location at the end of the rental period. Failure to return the vehicle on time or at the designated location may result in continued rental charges, penalties, or additional fees until the vehicle is successfully recovered by Jibon Electric. As the vehicles are not equipped with app-based locking functionality, the user must strictly follow return instructions provided by Jibon Electric at the end of each ride. Any improper return, abandonment, or failure to follow return procedures may be treated as misuse of the vehicle. Jibon Electric reserves the right to inspect the vehicle upon return and recover costs for damages, loss, excessive dirt, misuse, or missing accessories beyond normal wear and tear.

  • To access and use Jibon Electric services, the user is required to complete Know Your Customer (KYC) verification. The user agrees to provide valid and accurate documents, including but not limited to: [Aadhaar Card / PAN Card / Valid Driving Licence / Current Residential Address ] The user confirms that all information and documents submitted are true, accurate, and up to date. Jibon Electric reserves the right to verify, reject, suspend, or terminate services if any information is found to be false, misleading, incomplete, or unverifiable.

  • In the event of a breakdown, battery failure, or mechanical issue not caused by the user’s misuse, Jibon Electric may, at its discretion, arrange inspection or repair. Repair costs arising from misuse, negligence, prohibited use, or violation of this Agreement shall be borne by the user. Rental plans may be renewed, modified, or discontinued based on the applicable pricing, availability, and policies in force at that time. Continued use of the services constitutes acceptance of the updated terms, pricing, and policies.

    • 6. Prohibited Use and Restrictions

    The user agrees that they shall NOT use any vehicle or services provided by Jibon Electric in any of the following prohibited manners:

  • The user shall not use the services if they are below 18 years of age, or if they do not possess a valid driving license as required under applicable Indian law.

  • The user shall not operate the vehicle without wearing a helmet or without appropriate protective gear as required by law or safety standards.

  • The user shall not exceed any speed limits, including any speed restrictions imposed by Jibon Electric, applicable law, or local traffic authorities.

  • The user shall not tamper with, damage, modify, repair, dismantle, or interfere with the vehicle, battery, motor, electronics, GPS, locks, or any components of the vehicle, either personally or through any third party.

  • The user shall not operate the vehicle if they are physically or mentally unfit, including but not limited to fatigue, dizziness, illness, injury, or any condition that impairs safe operation.

  • The user shall not operate the vehicle under the influence of alcohol, drugs, narcotics, intoxicants, or any substance that may impair judgment, reflexes, or motor skills.

  • The user shall not use any mobile phone, headphones, earphones, or electronic devices while riding, except where legally permitted and without compromising safety.

  • The user shall not carry more than one rider, overload the vehicle, or carry goods, animals, or materials that exceed permitted limits or compromise safety.

  • The user shall not use the vehicle in unsafe or prohibited locations, including but not limited to highways where not permitted, restricted areas, private property without authorization, pedestrian-only zones, construction zones, or hazardous terrain.

  • The user shall not operate the vehicle in dangerous weather or visibility conditions, including heavy rain, flooding, fog, storms, hail, strong winds, or low-visibility situations.

  • The user shall not operate the vehicle if it appears damaged, malfunctioning, unsafe, or in need of repair, including issues related to brakes, lights, tires, battery, or steering.

  • The user shall not use the vehicle for racing, stunts, tricks, jumping, towing, pushing, pulling, or any activity beyond normal, lawful personal transportation.

  • The user shall not deface, vandalize, misuse, abandon, or improperly park the vehicle, or leave it in a manner that obstructs traffic, pedestrians, or public access.

  • The user shall not use the vehicle to commit or assist in any illegal, unlawful, or criminal activity, or in violation of any applicable law, regulation, or traffic rule.

  • The user shall not transfer, lend, sublicense, or allow any other person to use the vehicle or services under their account.

    • Violation of any of the above prohibited uses may result in immediate suspension or termination of the user’s access to the services, financial penalties, recovery of damages, and/or legal action, without any refund

    7. Limitation of Liability, Risk Assumption & Indemnification

  • The services provided by Jibon Electric, including the use of electric scooters or other vehicles, are provided strictly on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted operation, or safety.

  • The user expressly acknowledges and understands that riding or operating an electric vehicle is inherently risky and potentially dangerous and may result in injury, disability, paralysis, death, property damage, or other losses. Such risks may arise due to traffic conditions, road and surface conditions, weather, mechanical failure, battery failure, design limitations, collisions with vehicles, pedestrians, animals or objects, improper use, or negligence of the user or third parties. The user voluntarily chooses to use the services with full knowledge of these risks.

  • The user agrees that Jibon Electric does not guarantee the safety, performance, condition, battery life, range, or uninterrupted operation of any vehicle. Battery charge, speed, and performance may vary, and the vehicle may lose power or stop functioning at any time. The user is solely responsible for checking the condition of the vehicle before and during use and for deciding whether it is safe to operate. The user further understands that wearing safety equipment such as helmets or protective gear does not eliminate or reduce all risks, and Jibon Electric does not assume responsibility for injuries even if such equipment is used or not used.

  • The user expressly agrees not to operate any vehicle under the influence of alcohol, drugs, or intoxicating substances, and acknowledges that doing so significantly increases the risk of accidents and injury. Any injury, loss, or damage arising from such conduct shall be the sole responsibility of the user. To the fullest extent permitted by applicable law, the user releases, waives, and forever discharges Jibon Electric, its founders, directors, officers, employees, agents, partners, vendors, insurers, and affiliates from any and all claims, demands, actions, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to the use or inability to use the services, including but not limited to personal injury, death, property damage, negligence, equipment failure, or third-party acts.

  • The user agrees to indemnify, defend, and hold harmless Jibon Electric and its associated parties from and against any claims, losses, damages, liabilities, penalties, costs, or expenses (including reasonable legal fees) arising out of: the user’s use or misuse of the services, violation of this Agreement, violation of any law or regulation, negligent, reckless, or unlawful conduct, injury or damage caused to third parties or property.

  • The user acknowledges and agrees that Jibon Electric provides limited basic insurance coverage in connection with the use of its vehicles, subject to the terms, conditions, exclusions, and limits prescribed by the applicable insurance policy. Such insurance coverage, where applicable, may include third-party liability and limited personal accident coverage, with a maximum coverage amount up to ₹5,00,000 (Rupees Five Lakh only) or such other amount as determined by Jibon Electric or its insurance provider from time to time. The user understands and agrees that this insurance coverage is limited in nature and does not cover all risks, including but not limited to medical expenses beyond policy limits, loss or damage to personal property, indirect or consequential losses, or damages arising from violation of this Agreement or applicable law. The user is solely responsible for obtaining any additional insurance coverage they may deem necessary, including comprehensive medical, personal accident, or property insurance beyond the limited coverage provided. Jibon Electric shall not be liable for any claim exceeding the limits of the applicable insurance policy or for any claim excluded under such policy.

  • Without prejudice to the above, the total cumulative liability of Jibon Electric, if any, arising out of or related to the services or this Agreement, shall be strictly limited to the total fees actually paid by the user, or ₹2,000 (Rupees Two Thousand only), whichever is lower. The user confirms that they have read, understood, and voluntarily accepted this clause, and that this clause shall survive termination or expiry of this Agreement.

    • 8. Additional Terms of Use

    8.1: Compliance with Laws

    The user agrees to comply with all applicable central, state, and local laws, rules, regulations, traffic norms, and safety requirements while using the services and operating any vehicle provided by Jibon Electric. This includes compliance with motor vehicle laws, road safety regulations, and any local restrictions applicable in Guwahati, Assam, or other service areas.

    8.2: Eligibility and Licensing

    To use the services, the user must possess a valid and effective driving license as required under Indian law for operating the relevant category of vehicle. Jibon Electric does not provide or guarantee licensing, training, or riding certification, and the user assumes full responsibility for their eligibility to operate the vehicle.

    8.3: No Guarantee of Safety or Performance

    The user acknowledges that operating electric scooters or vehicles involves inherent risks, including risks arising from traffic conditions, weather, road conditions, mechanical issues, or user behavior. Jibon Electric does not guarantee that the vehicle will always be safe, hazard-free, uninterrupted, or suitable for all road or weather conditions.

    8.4: Battery, Charging, and Range Limitations

    The user understands and agrees that: Battery charge levels, riding range, speed, and performance may vary depending on usage, terrain, load, riding style, weather conditions, and other factors. Battery charge may decrease during use, and Jibon Electric does not guarantee minimum battery life, distance, or uninterrupted operation. The vehicle may lose power or stop functioning if the battery is depleted, and the user is solely responsible for planning usage accordingly.

    8.5: User Responsibility Before and During Use

    The user is solely responsible for: Checking the vehicle’s condition, including battery level, brakes, lights, tires, and overall safety, before initiating a ride. Ensuring that the vehicle is used only in a safe, lawful, and responsible manner. Ceasing operation immediately if the vehicle appears unsafe, malfunctioning, or unsuitable for continued use.

    8.6: No Assurance of Completion of Ride

    Jibon Electric does not guarantee that a ride can be completed without interruption. The vehicle may stop functioning due to low battery, technical issues, environmental conditions, or other factors. The user accepts full responsibility for managing such situations.

    8.7: Permitted Use Only

    The user agrees that: Vehicles are provided strictly for personal transportation as permitted by law. Vehicles shall not be used for racing, stunts, commercial activities, illegal purposes, towing, carrying excessive loads, or transporting prohibited items. Vehicles shall not be used under the influence of alcohol, drugs, or any intoxicating substances.

    8.8: Restricted Areas

    Vehicles shall not be operated in areas where such use is prohibited, including but not limited to highways where not permitted, restricted zones, private property without authorization, pedestrian-only zones (unless allowed), or unsafe terrain.

    8.9: No Public Transport or Common Carrier

    The user acknowledges that Jibon Electric is not a public transport service or common carrier. The service is provided on an “as-is” and “as-available” basis for individual users only.

    8.10: Rental Period Obligations

    During the rental period, the user must operate the vehicle in compliance with this Agreement. Failure to do so may result in suspension or termination of services, penalties, or additional charges as determined by Jibon Electric.

    9. Suspension & Termination of Services

    Jibon Electric reserves the right, at its sole discretion and without prior notice or cause, to suspend or terminate the user’s access to the services at any time, including but not limited to violation of these Terms, misuse of services, unsafe riding behavior, non-payment, or any activity deemed harmful to Jibon Electric, its users, or the public. Upon termination, the user’s right to access or use the services shall immediately cease. The user shall not be entitled to any refund of fees already paid, and Jibon Electric may charge any applicable outstanding fees, damages, penalties, or costs incurred prior to or resulting from such termination. Termination of this Agreement shall not affect any rights or obligations accrued prior to the termination date.

    10. User Content & Promotional Consent

    By using the services, the user grants Jibon Electric the irrevocable, royalty-free, worldwide right to photograph, record, reproduce, use, publish, display, and distribute the user’s image, likeness, voice, or any content created during or in connection with the use of the services, in any media now known or hereafter developed, for promotional, marketing, operational, or other lawful business purposes. The user hereby waives any right to inspect or approve such materials and waives any claims to compensation, royalties, or other consideration arising out of such use. This consent applies to use by Jibon Electric and its affiliates, partners, successors, and assigns. "Such use shall not include disclosure of sensitive personal information".

    11. General Legal Provisions

  • This Agreement constitutes the complete, final, and exclusive agreement between Jibon Electric and the user with respect to its subject matter and supersedes all prior or contemporaneous agreements, understandings, representations, or communications, whether written or oral. No failure or delay by Jibon Electric in exercising any right, power, or provision under this Agreement shall operate as a waiver of such right, power, or provision. If any provision or part thereof is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed severed, and the remaining provisions shall continue to remain in full force and effect.

  • This Agreement shall be governed by and construed in accordance with the laws of India. The courts of Guwahati, Assam shall have exclusive jurisdiction over all disputes arising out of or in connection with this Agreement.

  • Termination or expiry of this Agreement shall not affect any rights, obligations, or liabilities of the user that have accrued prior to such termination, including any outstanding payment obligations. This Agreement is entered into on a principal-to-principal basis. Nothing contained herein shall be deemed to create any partnership, joint venture, agency, employment, or fiduciary relationship between Jibon Electric and the user. The user shall not assign, transfer, or delegate any of their rights or obligations under this Agreement, in whole or in part, without the prior written consent of Jibon Electric.

    • 12. Force Majeure

    Notwithstanding anything contained in this Agreement, Jibon Electric shall not be liable for any failure or delay in performing its obligations hereunder if such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, pandemics, epidemics, lockdowns, lack of human or material resources, quarantine restrictions, strikes, riots, wars, fires, floods, earthquakes, explosions, acts of public enemy, or any governmental authority, law, regulation, order, or action (whether valid or invalid). In such events, Jibon Electric shall be excused from performance of its obligations to the extent affected by such Force Majeure event for the duration of the event, and such non-performance shall not be considered a breach of this Agreement.

    13. User Consent and Digital Acceptance

  • The user hereby affirms that (i) they are at least 18 years of age, (ii) they have the legal capacity and mental competence to enter into this Agreement, and (iii) they have read, understood, and voluntarily agreed to all the terms, conditions, policies, and provisions contained herein.

  • The user confirms that this Agreement has been entered into freely, voluntarily, and without any force, coercion, undue influence, or misrepresentation, and that they fully understand the legal consequences and obligations arising from accepting this Agreement.

  • Acceptance of this Agreement by clicking “I Agree”, registering on the application, accessing the services, or using any vehicle provided by Jibon Electric shall constitute valid and binding digital acceptance, equivalent to a physical signature, and shall be enforceable under applicable laws of India.
